DELIVERY TERMS

At PYLA SWIM, we want you to be fully satisfied with your purchases. If you receive an item that does not match your order, is defective, or does not meet your expectations, you have 14 days from the delivery date to notify us. After this period, no claims will be accepted.

Once your return request is approved, we will send you a return confirmation. You will then need to return the item in new, unworn, and unwashed condition, in its original packaging (the PYLA SWIM pouch), along with all accessories and tags, within 14 days of receiving the return validation. The return must be made exclusively via Mondial Relay at a pickup point.

Ensure that the item is in new condition, free from stains, odors, or hair, and that the hygiene protection is intact.

Exceptions: Please note that during promotional periods, sales, or other commercial offers, returns and exchanges are not possible.

Return Fees: Return shipping fees will only be reimbursed if the item received differs from the ordered one or is defective.

DELIVERY TIMES

Orders are delivered worldwide to the address provided by the customer during the order process, at the latest by the specified date depending on the delivery country.

  • In mainland France, PYLA SWIM strives to deliver quickly. Unless adverse conditions are communicated via various channels (email, Instagram...), orders are shipped within 48 business hours after payment is received via Mondial Relay (in pickup points). Delivery usually takes between 3 to 5 business days.

  • For Belgium, Luxembourg, Netherlands, Portugal, Spain, Germany, Italy, Poland, Austria, delivery via Mondial Relay (in pickup points) usually takes between 4 to 6 business days.

In case of a delay of more than 14 business days, the customer may contact PYLA SWIM by email to request the cancellation of their order within 60 business days. The sales contract will be terminated upon receipt of the email or letter from the customer, unless delivery occurs in the meantime. If the order is canceled, the customer will be refunded within 30 days after the cancellation is confirmed by email. If the parcel is received after the cancellation, PYLA SWIM will refund the items and return shipping fees upon receipt of the items in perfect condition.

Each delivery is considered completed as soon as the parcel is made available to the customer, as confirmed by the transporter's tracking system. If the parcel is damaged or if the item does not match the order, the customer must contact customer service by email within 7 days of receipt to obtain a return authorization.

ITEM PRICES

Prices on the Pyla Swim website are in euros, including VAT, excluding processing and shipping fees.

They include any discounts applicable at the time of the order.

New taxes or contributions, such as those related to the environment, may be added to the item prices.

Prices do not include shipping fees (postage, packaging, and assembly of the parcel according to applicable rates).

The shipping cost will be shown before order confirmation.

Pyla Swim reserves the right to modify prices at any time, with items being charged according to the prices in effect at the time of the order. The price charged is the one displayed at the time of ordering.

RIGHT OF WITHDRAWAL

In accordance with national and European legal provisions, the customer has 14 days from the receipt of their order to exercise their right of withdrawal without giving any reason or incurring any penalties, except for return shipping fees.

Please note, without a request via email, parcels will not be considered.

Items must be returned properly protected, in their original packaging, and in perfect resellable condition (not damaged, used, or soiled). PYLA SWIM recommends trying on the products while wearing underwear.

Once the return is validated, PYLA SWIM commits to refunding the customer the full amount paid as quickly as possible and no later than 30 days from the exercise of the right of withdrawal, to the bank account used for payment.

The risks associated with the return are borne by the customer, which is why we ask you to cover the parcel up to €125, which will be reimbursed upon receipt by Pyla Swim.

SWIMSUIT TAGS

Some swimsuits may be missing the tag because it is delicate and can easily detach. Don't worry, we account for this! A second Pyla Swim tag, fixed to the swimsuit, serves as a replacement.

⚠️ Do not cut off the Pyla Swim tag (pink)! Without this tag, the swimsuit will no longer be eligible for return.

CUSTOMER SERVICE

For any information, order tracking, exercise of the right of withdrawal, or warranty, the customer must contact customer service via email using the contact form located on the contact page of the website.

WARRANTIES

Items are guaranteed against conformity defects and hidden defects in accordance with Articles 1641 to 1649 of the Civil Code and Articles L211-1 and following of the Consumer Code, from the time of delivery:

  • Article 1641 of the Civil Code: The seller guarantees hidden defects in the sold item that render it unfit for its intended use or that diminish its use to such an extent that the buyer would not have acquired it or would have paid a lower price had they known about them.
  • Article 1648, paragraph 1 of the Civil Code: The action for hidden defects must be filed by the buyer within two years of discovering the defect.
  • Article L211-4 of the Consumer Code: The seller must deliver goods in accordance with the contract and is responsible for defects in conformity existing at the time of delivery, as well as defects resulting from packaging, assembly instructions, or installation if it is their responsibility.
  • Article L211-5 of the Consumer Code: For the goods to be compliant, they must be fit for the usual use expected, match the seller's description, and have the qualities publicly declared by the seller, producer, or their representative.
  • Article L211-12 of the Consumer Code: The action for compliance guarantee is prescribed within two years of the delivery of the goods.

This warranty allows the customer to return defective or non-conforming items for a refund under the conditions described.

EVIDENCE CONVENTION

The customer acknowledges and agrees that the order recording systems constitute proof of all transactions between PYLA SWIM and the customer.

The customer acknowledges and agrees that the acceptance of the T&Cs is evidenced by checking the box "I have read and accept the terms and conditions."

The customer agrees that the computerized data stored on PYLA SWIM’s servers, under reasonable security and integrity conditions, will be considered as irrefutable proof of the acceptance of the T&Cs and all transactions between PYLA SWIM and the customer.

PYLA SWIM will archive the order forms and invoices on a reliable and durable medium, in accordance with Article 1348 of the Civil Code, and ensure their availability to the customer at any time upon request, in accordance with Article L. 134-2 of the Consumer Code.

Therefore, except in the case of a manifest error proven by the customer, the customer will not be able to dispute the validity or probative value of the T&Cs and the order based on legal provisions requiring written or signed documents to constitute proof.

These elements constitute acceptable, valid, and enforceable proof in the same way as any written document.

The customer can print, download, and keep a copy of the T&Cs at any time.
